Terms and Conditions

TERMS OF PAYMENT:

50% upon signing of contract.

50% balance before delivery date to be paid at the showroom. Please allow 3 working days clearing for check payments. Make all check payments to Maison & Smith, Inc./Design Source Int’l, Inc. only.

  

CONTRACT TERMS:

1. Prices quoted shall be valid for a period of seven (7) days. Prices shall remain effective only up to (6) months from date of receipt of down payment unless fully paid and delivered before then.

2. Installation accessories shall only include film, foam and glue. Floor moldings, skirting boards, sealant, putty and other such materials shall be charged separately.

3. Additional transportation, overtime, and other incidental expenses shall be charged for out of town delivery and installation. The delivery charge includes ground floor only as the unloading point and that the distance does not exceed (10) meters from unloading point. Overtime expenses shall be charged for work requests beyond the usual eight (8) hours work schedule or night time work.

4. Unless otherwise specified, the number of packs as stated in this order form shall be the final basis of the BUYER’S payment to the SELLER. Any additional planks or any other material required shall be paid for by the BUYER. Fee for additional delivery, inspection and installation shall likewise be charged accordingly. Unopened packs may be returned for refund strictly within one (1) week after installation only. Two (2) weeks for out of town projects. One (1) month for projects not installed by us. SELLER shall have the right to refuse to accept any request for refund beyond that. Returns and refunds are not allowed for special indent orders.

5. The right to repossess and pull out subject articles is reserved by the SELLER in the event that the BUYER should fail to comply fully with these terms and conditions and all payments already made by BUYER shall be forfeited in SELLER’S favor, to be considered as rental for the use of the articles and/or liquidated damages. All expenses of repossession shall be borne by the BUYER. Toward this end, SELLER shall have the right to enter the premises where the planks are installed within reasonable hours for the purpose of pulling out said articles.

6. The SELLER shall exercise due diligence and care in laying and installation of planks within the premises of the BUYER. SELLER shall not be liable or responsible for any damage to the premises resulting from any cause/s beyond the control of the SELLER’S employees to prevent. If delivery has been made by the SELLER but the BUYER’S place is not yet ready for installation, the BUYER shall be fully responsible for the materials delivered, and in case of loss or damage, BUYER shall be liable thereof.

7. The SELLER reserves the right to request, at no cost to the SELLER the removal of baseboards in cases where baseboards are already installed and finished before the installation / repair of the laminate floor.

8. In cases where BUYER shall undertake his/her own installation of the floor, BUYER agrees that he/she will not hold the SELLER responsible for any damage incurred from any improper handling and installation of the floor.

9. The BUYER is obliged to report in writing any defect in the installation before the lapse of three (3) working days from completion of the job. Failure of which, the BUYER shall be conclusively deemed to have accepted the work as having been done properly and in good order and condition.

10. Cancellation fee of 15% of total contract price will be charged in case thereof.

11. Stocks reserved should be delivered and fully paid within one month of expected delivery date. Any delay shall be charged with 1% interest and 1% storage fee.

12. BUYER agrees that all legal actions that may be brought on or by virtue of this contract shall be in the proper courts of the city of Quezon City to the exclusion of all other venues. The acceptance of this offer constitute a complete and binding contract to the above specification and terms contained hereof after approval by an authorized representative of the company. Any alteration or correction must be initialized and dated by the SELLER’S and BUYER’S authorized representative.

IMPORTANT NOTICE:

1. We leave a 10mm gap all around the room to allow for the expansion of the floor. Baseboards must be installed AFTER the laminate flooring in order to cover the gap. Flooring conforms to the standards set by the European Producers of Laminate Flooring (EPLF). The following tolerances may occur and are acceptable: Height difference at the joint up to a maximum of 0.15 mm; Convex and concave measured across the full width of the installed planks at 0.25 mm; Openings within the floor surface at a maximum width of 0.2 mm.

2. For installations that exceed 8x8 meters in any directions, moldings are needed to avoid excessive expansion.

3. Cabinets and Furnitures should not be fixed or place on top of the laminate floor because it prevents normal expansions and contractions.

4. Delivery and installation will be scheduled within one week from our acceptance that subfloor is ready for installation. Preparation and leveling of sub-floors are not included in this offer.

5. To ensure colour availability, please reserve at least one month before expected installation.

6. Wood, as product of nature, is subject to variation in tone, color and grain.
